Supreme Court of Georgia Accepts Federal Request for Guidance on DeKalb School Board Case
On Monday, the Supreme Court of Georgia accepted federal judge Richard Story’s request to address the question of whether the governor exceeded his authority and violated the state constitution when he removed six members of the DeKalb Board of Education.
WABE legal analyst Page Pate says Judge Story is asking the Georgia court for help. “Federal judges don’t like to interpret Georgia law for the first time. They don’t like to try to make a determination that’s purely a state law question if there’s not a lot of guidance out there.”
Each side – the school board members and the state – will have 20 days to file legal briefs and ask to make oral arguments if they choose to do so.An audio version of this story
Judge Story denied the former board members’ request to prevent their removal under the U.S. Constitution. If the Georgia Supreme Court finds the ouster violated the state constitution, the group could file a request to get their jobs back.
The governor has already appointed six replacement members. The first meeting of the reconstituted board is March 20th.
