A Fulton County judge has rejected the state’s request to “cancel” or postpone a lawsuit over Georgia’s recently enacted abortion restrictions. It’s now set to go to trial later this month.
The ACLU filed the lawsuit against the six-week abortion law known as H.B. 481 in July on behalf of abortion-rights groups and providers, arguing it violates privacy protections under the state constitution.
In his order denying the state’s request, Fulton County Superior Court Judge Robert McBurney wrote there’s no basis to cancel or postpone the trial.
McBurney ordered both sides to prepare for trial and present their case.
The two-day trial is set to begin in Atlanta on October 24.
