Battle Over Unincorporated DeKalb County Office Park Continues

The fight over an unincorporated DeKalb County office park continues. Earlier this week, a DeKalb Superior Court judge temporarily blocked the City of Brookhaven from voting to annex Century Center before a court hearing with the City of Chamblee.

The battle started because residents who live near the Center are scheduled to vote in November on annexing the 100-acre office park and land around it into Chamblee.  That’s due to an act of the state legislature. Meanwhile, Brookhaven began annexation plans after Center owners petitioned the city earlier this month. Chamblee Acting City Manager Marc Johnson says the law is on Chamblee’s side.

“We believe it’s clear that the ultimate authority is the legislature, and you can’t trump them.”

Meanwhile, Brookhaven argues the annexation is allowed under state law because 100-percent of the property owners requested the annexation. Marie Garrett is Brookhaven’s City Manager.

“We feel like we are in accordance with the annexation law of the state of Georgia and we’ve had a property owner seek annexation and it has been the city’s philosophy that those that wish to come into the city we will give every consideration to that and allow that application to move forward.”

A court hearing is expected to take place in less than thirty days.
