Cheshire Bridge Legislation Clears Zoning Committee, Sets Up Full Council Vote Monday

A plan to redevelop an area of Atlanta known for its adult businesses got a major boost this week and will go before the full City Council Monday.

Despite opposition from the city’s zoning review board, the City Council’s zoning committee approved the legislation Wednesday. The bill outlaws all strip clubs and adult video stores on Cheshire Bridge Road beginning in 2018.

At the meeting, the bill’s sponsor, councilman Alex Wan, responded to critics, who say the legislation violates private property rights.

“Yes, I admit it’s a bold tool but it is a tool that’s been supported by the city’s planning department, the law department, and…there is overwhelming community support.”

But adult businesses along Cheshire Bridge say if the bill becomes law, a legal challenge is almost certain.

“This is the first time ever where the government has stepped up and said you can’t be here and chased out tenants. That’s never, ever happened and it’s dangerous legislation and really it’s taking without compensation,” said Michael Morrison of the adult store Inserection.

City attorney Jeff Haymore has said compensation isn’t necessary because there’s no takeover of property, only a restriction on a type of business in the area.
