A DeKalb citizens group has filed a lawsuit trying to stop construction of a Walmart at Suburban Plaza shopping center.
Good Growth DeKalb is suing the county government. It says the DeKalb Zoning Board of Appeals did not have the authority to deny the group’s appeal of the developer’s building permit.
The lawsuit is over a technical issue, but the original appeal contended that the county is violating its own ordinances in granting the permit.
According to group spokesperson Ann Mauney, “They have not met the county’s ordinances regarding hydrology, how they’re dealing with water, how they’ve dealt with the trees on the site and third, is how they have dealt with the funneled truck traffic that’s going to be coming from and to the Walmart store.”
