Attorneys for six suspended members of the DeKalb County school board have voluntarily dismissed a complaint filed in Fulton County Superior Court. That means a state court hearing scheduled for Thursday will not take place. The lawsuit challenged the constitutionality of a state law that allows the governor to suspend local school board members. The case was dismissed without prejudice, so attorneys for the DeKalb school board can re-file at a later date.
However, a federal hearing on the same issue is still scheduled for Friday.
