A DeKalb County judge handed down a mixed bag of rulings in Good Growth DeKalb’s fight to stop Selig Enterprises from building a Walmart at Suburban Plaza.
While Superior Court Judge Tangela Barrie ruled that the group does not have legal standing to challenge the building permit, she did leave open the door for the group to appeal administratively through the county government.
According to Louise Runyon of Good Growth DeKalb, “We definitely do not feel that this is an out-and-out victory for Selig. In this case, it’s not over yet: this is just one ruling, and we have various legal options.”
Runyon would not say what those options are, and the group’s attorney did not return calls for comment.
Selig Enterprises also did not return WABE’s calls. However Walmart spokesman Bill Wertz says the retailer is ready to start construction based on Selig’s plans for the shopping center as a whole, saying “Some of that work will have to do be done before we can start on our part of it, the Walmart store. But we’re hoping to get started early in the new year.”
Runyon says Good Growth DeKalb says it will reveal its plans sometime next week.
