Judge Says “No” to Brookhaven’s Annexation of Century Center
A DeKalb County Superior Court judge ruled Monday the city of Brookhaven can’t annex land which includes a prime office complex. The decision comes after Brookhaven’s city council has already approved the move.

Judge Tangela M. Barrie’s decision means DeKalb County voters will get the first say in the matter. Residents near the Century Center office complex will vote next Tuesday on whether they want the area to become part of the city of Chamblee.
Chamblee City Manager Marc Johnson says he agrees with the judge’s ruling, although the city doesn’t have an official position on the annexation.
“Some people will say, ‘Well, Chamblee’s trying to annex,’ or, ‘Chamblee’s trying to do,’” Johnson says. “This is driven entirely by people in that community. What we did, though, was try to protect the rights of the people in that community.”
If voters decide not to become part of Chamblee, then Brookhaven can annex the property. Brookhaven officials called the ruling “disappointing” and said they won’t act until after next week’s election.
